GENERAL TERMS & CONDITIONS

The General Terms & Conditions apply, without restriction or reservation, to sales made by Piñones de Castilla S.A, with registered office at CTRA. VILLAVERDE S/N 47430 PEDRAJAS DE SAN ESTEBAN, Valladolid (SPAIN), to customers who purchase the products offered for sale through the website. The sales made are online sales regulated by the current Spanish regulation on the matter.

The General T&C are accessible at all times from the website and will prevail over other document with which they contradict, without prejudice to the provisions of current legislation.

The validation of the order by the customer implies the unreserved acceptance of these General T&C. In the case of modification, they will be binding for all the purchases made after their publication on the website.

Content and Information provided

Piñones de Castilla reserves the right to modify the commercial offer presented on the website at any time (modifications on products, prices, promotions and other commercial and service conditions). They commit to offer all the information contained on the website truthfully and without typographical errors. In the event that an error of this type happens, it will be corrected immediately. If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on said error, Piñones de Castilla will inform the customer of said error and the customer will have the right to cancel their purchase at no cost on their part.

In the case of images, and due to changes in both format and products, there may be discrepancies between the image shown and the actual product, a fact that will be changed as soon as possible. Regarding the visualization of the image, due to the visualization of the colour on the monitor and depending on its settings, there may be variations in colour in regard to reality. We will not be able to accept exchanges or returns due to the fact that the colour is not exactly the same as expected. Returns will only be accepted if a product arrives in poor condition due to transport problems or origin manufacturing defects.

In the event that the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel their purchase at no cost.


Registration as a client

To place the order, the user can, previously or during the order, sign in as a customer, for which the user will be taken to a page to fill in all the information necessary to open an account if it is the first order, or to identify itself if the user is already an account holder.

The information required to open an account is: name, surname, billing address, telephone number, e-mail address, username, password and acceptance of the privacy policy and General Terms & Conditions.

Sales system

To make a purchase, the user will select the products and add them to “my basket”.

Price and applicable tax

Prices are all expressed in EUROS and include shipping costs from €75 (only for the peninsula, Portugal -not the islands- and the Balearic Islands). The exposed prices may be reviewed and modified at any time if the conditions require it. Products are available for sale while stocks last.

The products are served according to the rates in force on the website at the time of registering the order. The prices are expressed in EUROS and include the Value Added Tax (VAT) which, if any, has to be applied.

Accepted forms of payment and Secure payment

When making the order, the customer can freely choose to pay for the purchases made by credit cards, or through Bizum’s secure gateway (the accepted card models are provided at the time of purchase). We guarantee that each of the transactions made is 100% secure. All operations involving the transmission of personal or banking data are carried out using a secure environment (payment gateways). The store uses a server based on REDSYS Virtual POS technology system. All the information that you transmit to us travels encrypted through the network. Likewise, the data on your credit card is not registered in any database, it goes directly to the POS (Bank Point of Sale Terminal).

When paying by card, the following information will always be requested: Cardholder name, card number, expiration date, and a Validation Code that matches with the last 3 digits of the number printed in italics on the back of your card. When you click to buy, the page will provide you with a new purchase security page, thus offering more guarantees about the security of the transactions.

Important: If the order, once confirmed and sent, is not accepted by the client, it is the client itself who must bear the costs incurred. The client will receive an invoice or proof of purchase by post and/or email. All false orders, or attempted fraud, will be reported to the competent authorities. All information necessary to collaborate with the investigation have to be provided.

Charges for payment methods use

Piñones de Castilla undertakes not to bill consumers for the use of certain means of payment, charges that exceed the cost borne by the use of such means.

Electronic invoice

Piñones de Castilla will provide consumers with an electronic invoice and this right does not entail any additional cost to the consumer. The paper invoice may also be issued when the consumer requests it, with prior consent.

Forms, Costs y Shipping terms

Shipments and deliveries are made from Monday to Friday, except holidays.

All our shipments are made through a unique transport company (SEUR). The amount of shipping costs is calculated automatically at the time of placing the order, depending on the selected destination and payment method.

To find out exactly what the order will cost, select the products you wish to purchase, go to the basket and choose the payment method. The total amount of the purchase will appear, fully detailed, including shipping costs.

In that moment, you can decide whether or not to continue with the purchase process. To continue with your order, you must press “Place order”.

The shipping methods depend on the destination, as well as the delivery time:

National Shipments (Spain):

The shipment is made through SEUR with a fixed cost of ……. €5,00. For orders of less than €75.
Delivery time in 24-48 hours (maximum 48 hours, depending on the time of placing the order).

Balearic Islands and Portugal (without islands):

The shipment is made through SEUR with a fixed cost of ……. €6,50. For orders of less than €75.
Approximate delivery time of 3 days depending on the time of placing the order and the destination.
Orders of an amount equal or greater than €75: Free shipping (only for Spain, Portugal -not the islands- and the Balearic Islands)

Shipping to countries fo the EU:

Limited shipping is available to the following EU countries: Portugal, Italy, France, Germany and Belgium.

The shipment is made through SEUR with a fixed cost of ……. €15,50.
Approximate delivery time of 5 to 7 days depending on the time of placing the order and the destination.

The delivery time that is stipulated for our products is counted from the time of placing the order and received the payment. All shipping conditions are counted from the day of purchase as long as it is before 1:00 p.m.

The courier will take it to your address. If you do not receive it, you can contact us through the Contact section of our website.

All shipments are 100% insured by an all-risk insurance offered by the corresponding transport company.

Buy in our facilities’ store in Piñones de Castilla

The merchandise purchased in our facilities’ store, addresses in CTRA. VILLAVERDE S/N, 47430 PEDRAJAS DE SAN ESTEBAN, Valladolid (Spain), will not incur any shipping costs.

Special prices and shipping conditions available in our facilities for larger dimensions orders (equal to or greater than 10 kilograms). Contact us.

Warranty

The product warranty is established by the manufacturer, in this case, Piñones de Castilla S.A. In case of failure, you must contact us through the Contact section of our website so that we have proof of the defective product, authorize its return and tell you the steps to follow.

In order for such guarantee to operate, it is necessary that the product presents a origin manufacturing defect and the customer must keep the purchase invoice of the product. The warranty only covers origin manufacturing defect, in accordance with current legislation. As a matter of fact, the deterioration of the product due to an erroneous conservation condition is excluded, as well as the alteration in its original conditions due to improper use, which, in any case, will be the responsibility of the client.

Product returns and exchanges

Incorrect or incomplete product. If the product delivered does not match with the one requested in the order or is incomplete, you must notify us immediately. Contact us through the Contact section in our website and we will process your incident as soon as possible.

Right of termination/withdrawal. The Client has the right to rescind/withdraw the contract, without indicating the reasons, within a period of 10 consecutive days from receipt of order (rescission/withdrawal period), as long as the goods keep their original packaging intact, unused, without scratches, broken packaging or damaged and including all the documentation that accompanies the product. The withdrawal period expires after 10 consecutive days, from the date on which the Customer or a third party (other than the carrier and designated by the Customer) receives the merchandise.

In order to exercise the right of termination/withdrawal, the Client is obligated to notify the company its decision to terminate the contract by means of an explicit statement (for example, a letter sent by post or email). In order to respect the termination period, it is appropriate for the Client to send the communication regarding the exercise of the right before the end of the termination period of 10 consecutive days.

The refund will be made once the merchandise is received at the facilities and using the same form of payment used by the Client in the initial transaction. Once received and verified by our staff that the product is in the same state in which it was sent, that is, in its original sealed packaging, in perfect condition, without having been used and accompanied by all the documents, we will proceed to refund the total amount of the product, according to the payment method. The refund may be suspended if it is found that there is damage or alterations in the product.
Open and used product. The Client will not be able to exercise the right of rescission or withdrawal in the case of sealed goods which have been opened and used after delivery, that is, for reasons of hygiene, related to health protection, returns of perishables products already opened are not accepted, due to the fact that their subsequent sale would not be possible, as long as the reason is not due to origin manufacturing defect (see Guarantee).

If the return of the order is for other reasons than: origin manufacturing defects, incomplete shipment or incorrect shipment, we will not be responsible for the costs of the return.

If the package arrives in poor conditions such as broken and/or open, you must make a claim to the transport company through the carrier and immediately notify info@pinonesdecastilla.com for us to carry out the appropriate follow-up, and, in that case, the insurance will be responsible of paying for another order.
In the event that the customer has met all the requirements set forth herein, Piñones de Castilla undertakes to reimburse the customer for the price of the returned product within thirty (30) days from receipt of the product using the same form of payment used in the initial transaction. The customer is informed that the return costs will be borne by Piñones de Castilla, under the conditions set out above.

Customers Obligations

The client undertakes at all times to provide truthful information about the data requested in the user registration or in order forms, and to keep them updated at all times.

The customer agrees to accept all the provisions and conditions contained in these General Terms and Conditions, understanding that they reflect the best will of the requested order and providing a delivery address where the requested order can be delivered within the usual delivery hours. In the event of breaching of the client obligations as described, Piñones de Castilla will not have any responsibility for the delay or impossibility of delivering the order requested by the client.

Intellectual Property

The content of this website is the property of Piñones de Castilla S.A. and is protected by Spanish and international legislation relating to intellectual property. Consequently, the total or partial reproduction, copy and/or re-publishing thereof is expressly forbidden, regardless of the purpose or the medium used, and could constitute a civil and criminal offense.

Piñones de Castilla S.A. is the owner of all the intellectual property rights over the studies, designs, models and prototypes made to provide the customer service that may appear on the web. The client is prohibited from reproducing and exploiting the aforementioned studies, designs, models and prototypes without prior, express and written authorization from Piñones de Castilla, who may condition said authorization on obtaining an economic compensation.

Litigation

The client is informed that any controversy or litigation to which this contract may give rise, it could be resolved in the Spanish Courts and Tribunals corresponding to the consumer’s domicile.

In the event that the purchasing party is domiciled outside of Spain, both parties expressly renounce any other jurisdiction to the Courts and Tribunals of Valladolid, (Spain).

In any case, at our registered office [CTRA. Villaverde, S/N 47430 Pedrajas de San Esteban, Valladolid (Spain)], there are complaint forms available for the customer.
Applicable Legislation

The law to be applied shall be the laws and regulations in force in Spain or, in the absence of any, in the European Union.
